Have you ever heard that juries remember 10% of what they read, 20% of what they hear, 30% of what they see and 50% of what they hear and see? I have, and I’ve actually have used it many times while explaining why trial presentations are beneficial.

Congrats to Lawrence Morales of San Antonio for a well tried and long trial in Bexar County. This case sparked lots of emotions and hopefully will show other apartment managers to follow the rules and keep their unoccupied apartments locked and not allow random people to stay in them.

$370,000 Verdict – Car Accident

Congrats to Damon Garza and Desi Martinez (http://www.martinez-law.com/) on a well tried case in Laredo last week. $360,000 jury verdict in a week long trial against a police officer that was speeding without lights/sirens and hit their client.

Congratulations to Marcella De La Casa for an excellent tried trial against one of Texas’ top plaintiff attorneys Fred Hagans. She successfully defended a very serious claim against one of San Antonio’s highest ranked home builders over the past 3 weeks.

Jury returned with a $0 verdict.

$15 Million Verdict – Product Liability

After a week long bench trial the judge has returned a $15 million verdict in the 21 Rio scaffolding collapse trial. Thanks to to the team of plaintiff attorneys lead by John Tippit for trusting DLS with their presentation needs!

A judge has found a construction company guilty of negligence in the deaths of three Austin workers.

Travis County Judge Scott Jenkins has ordered American Mast Climbers to pay $15 million in damages to the workers’ families.

The men fell to their deaths in June 2009, when faulty scaffolding collapsed at the 21 Rio construction site in the West Campus neighborhood.

Four contractors, including American Mast Climbers, received safety citations following the accident.

Two of the companies, Greater Metroplex Interiors and Andres Construction, settled out of court. Capoera Construction disappeared without paying any fines.

Mast Climber Scaffold Collapse Trial

Last week I provided trial presentation services for a group of plaintiff firms in Austin, TX. This trial was different and interesting due to it being a bench trial. I’ve never been involved in a case where a judge was asked to award $50million in a wrongful death lawsuit.

The most shocking part is these climbers are built in someone’s backyard, without the requirement of an engineer. The platforms in this case were held on by two bolts… two bolts. And the “manufacturer” used the wrong bolts. Extremely sad but alarming trial.
